What You Need to Play Online Casino in New Jersey

Short answer

Three things, all set out in New Jersey’s own rules:

1. Be 21 or older. The casino must verify your age when you open the account.
2. Be physically in New Jersey when you wager. Licensed sites run a location check (geolocation) and won’t take bets from outside an authorized area.
3. Pass identity verification. The casino checks your legal name, date of birth, address and Social Security number details before you can deposit.

You also need to play on a site the NJ Division of Gaming Enforcement (DGE) has approved. About its Internet Gaming Sites list, the DGE says: “Any site not included on this list is NOT approved to offer Internet gaming in the State of New Jersey.”

1. You must be 21 or older

When you open an account, New Jersey’s internet gaming rules (N.J.A.C. 13:69O-1.3) require the casino to “Verify that the patron is of the legal age of 21, not self-excluded, on the exclusion list, or otherwise prohibited from participation in gaming”.

You also confirm it yourself: the casino must “Record the patron's acknowledgement that the legal age for Internet or mobile gaming is 21” and that no one else may use your account.

2. You must be physically in New Jersey (geolocation)

The Casino Control Act’s internet gaming article (N.J.S.A. 5:12-95.17 et seq.), says a casino may accept an internet wager only when “the casino licensee has verified the account holder's physical presence in this State” (N.J.S.A. 5:12-95.23).

The DGE’s regulations spell out how. The gaming system “shall employ a mechanism to detect the physical location of a patron upon logging into the gaming system and as frequently as specified in the Internet gaming permit holder's approved submission.” If it finds you outside an authorized area, “the system shall not accept wagers until such time that the patron is in an authorized location” (N.J.A.C. 13:69O-1.2(e)).

What that means for you:

• Expect a location check when you log in, and possibly again while you play.
• If you cross out of the state, wagering stops until you’re back in an authorized location.
• By accepting the site’s terms, you consent to “the monitoring and recording by the operator and/or the Division of any wagering communications and geographic location information”.

The law allows narrow exceptions (N.J.S.A. 5:12-95.31), but for everyday play, plan on being in New Jersey. Our guides list “Wrong state selected or not physically in NJ when required” as a common reason an offer fails.

3. You must pass identity verification

To open an account, the casino creates an electronic file that includes, at a minimum, your verified legal name, verified date of birth, verified residential address (a post office box is not acceptable), email address and phone number, plus the “Verified entire or last four digits of the patron's Social Security number, if voluntarily provided, or equivalent for a foreign patron, such as a passport or taxpayer identification number” (N.J.A.C. 13:69O-1.3(b)1).

The casino then verifies your identity. Current rules make multi-source authentication the “primary method for verifying the accuracy of patron KYC data prior to the creation of an account”, with manual checks of your documents as a fallback, and the verification method “shall include the use of remote multi-sourced authentication, which may include third-party and governmental databases, as approved by the Division” (N.J.A.C. 13:69O-1.3(b)2–3).

The DGE’s published Know Your Customer (KYC) requirements add detail. Before “any patron deposit or other patron initiated activity”:

• Exact match required: date of birth, SSN and last name.
• Flexible match allowed: first name and address. The DGE’s example: “Bob or Robert would pass”. But “PO Box is not acceptable”.
• Proof it’s really you: any one of “Answering three knowledge-based questions”, “Verification of device ID and phone number matched with the patron’s KYC data”, “Government issued ID”, or another approved method.

Practical upshot: sign up with details that match your records. The casino must also re-verify your identification if there is reasonable suspicion that it has been compromised (N.J.A.C. 13:69O-1.3(m)).

Other account rules worth knowing

• One account each: “A patron shall have only one Internet or mobile gaming account for each Internet gaming intermediary.” Each account must be non-transferable and unique to you.
• You consent to checks: the site’s terms must include your consent “to have the licensee confirm the patron's age and identity”.
• Self-excluded players can’t open accounts: the age check above also screens out anyone self-excluded or on the exclusion list. See responsible gaming.
